The Crypto Con Lawyer*: The First Settlement Offer in Glorified Paralegal v. Legitimate Lawyer (PART 2)

* Evans is a CILEX Chartered Legal Executive with limited practice rights in England and Wales. How he is able to call himself a lawyer under their laws, I have no idea, but in reality, he is a glorified paralegal.

Alright folks, let me set the stage for you. We’ve got Cal Evans, a so-called ” international lawyer” from Gresham International, who’s been running around scamming people left and right. On the other side, there’s me, Jonathan Dunsmoor, a legitimate lawyer who’s been exposing Evans’ fraudulent ways.

Now, I try to be a reasonable guy. I believe that everyone has their price and that reasonable minds can come to reasonable solutions. So, in the case of Evans (glorified paralegal) v. Dunsmoor (legitimate lawyer), I decided to offer Evans a good faith settlement. Here’s the deal:

  1. Evans admits to his fraud
  2. Creates a Victims Restitution Fund
  3. Works with the authorities to bring his scammer buddies to justice

I even gave Evans a few days to think it over, with a deadline of today, Monday, November 18th at 9am ET. He had the Word doc to make any changes he wanted as a counteroffer. But guess what? He didn’t take me up on it! He didn’t even offer to provide the complaint or counter!

Now, here’s where it gets really amusing. Evans is representing himself in this case! I guess only a complete fool would try to pursue a defamation case in a jurisdiction in which he is not licensed as the plaintiff! If he thinks he’s going to survive on the so-called merits of his complaint, which I assume is some sort of defamation claim under Wisconsin law, he’s got another thing coming. And let’s not forget, even though his Wisconsin in-house practice rights have been “de-registered,” he could still be subject to sanctions for this nonsense.

First off, let’s talk about personal jurisdiction. I’ve been to Wisconsin exactly once in my life, and it was before the pandemic. How Evans thinks he has jurisdiction over me when I haven’t even seen the complaint yet is beyond me.

Secondly, in any defamation claim, you have to consider whether the person is a public or private figure. And what do we have with a guy who brags about his thousands of Instagram followers? Ding ding ding! A public figure.

Sorry Evans, you don’t get to constantly post about yourself and buy obscure magazine covers, then turn around and claim you’re a private figure. That’s strike 2 of 2.

Moving on to the third point, while I may not be an expert in Wisconsin law, I do know they have that famous “truth as a defense” rule for defamation. And that’s where the beauty of this mess lies. I’ve uncovered 136+ lies and misrepresentations by Evans (with more to come). I even offered him the chance to go through the list and point out which ones are true and which are false:

But of course, he didn’t take me up on that either. Which makes this whole thing a laughing stock, because presumably, the complaint I still haven’t been served with doesn’t even specify which of the alleged “defamatory statements” are untrue. Imagine being in a deposition, going through those 130+ lies line by line, and THEN trying to argue that one of Evans’ lies isn’t actually a lie. Talk about “defamatory.” That’s strike 3 of 3, folks.

Finally, let’s talk about the last hurdle, strike 4 of 4 (yeah, I know we’re not playing baseball). In defamation claims, you have to show that reputational harm was done, especially for public figures. Well, good luck with that! Evans was quoted on CNBC as being part of the Giza scam in 2018, a year before he was even licensed by CILEx. Multiple websites have called him out for his involvement in the Ardana rug pull. He’s being publicly called out and sued in the Aubit/Freeway scam. And most recently, he’s been talked about for his role in Burency, an ICO he bragged on LinkedIn about raising $7M for, only to fail to deliver as the token price tanked.

Like I said, 4 for 4. The man didn’t have a good reputation to damage in the first place. With so many lies, the only thing that could damage his reputation is his own fraud. Four for four.

In summary, Evans should take the settlement offer and make things right before the real legal wolves show up. They won’t be as nice as me, because they can actually prosecute. I’m just defending myself at this point. Imagine what’ll happen when I go on the offense. 😎😁

P.S. – Surprise, surprise, Evans’ claims about suing LinkedIn and Twitter/X over my posts seem to be total BS. Tell me you don’t know the First Amendment or Section 230 without telling me you don’t know the First Amendment or Section 230, comes to mind.

We can’t find any filings related to these supposed complaints. Maybe he filed them with some regulatory org instead of seeking an injunction against the companies like you normally would. But he’s a liar and a con man, so who the hell knows at this point.
